This Privacy Policy explains how we collect, use, share, and protect your personal information when you access or use our Services in all 50 U.S. states.

By accessing or using our Services, you acknowledge that you have read, understand, and agree to this Privacy Policy and our Terms of Use. If you do not agree, you must discontinue your use of the Services.

1. ACCEPTANCE OF PRIVACY POLICY & TERMS OF USE

1. Binding Agreement
   • Your use of the Services is subject to both this Privacy Policy and our Terms of Use. By using our Services, you agree to be bound by both documents.
   • If you do not agree to this Privacy Policy and our Terms of Use, you may not use our Services.
2. No Use Without Acceptance
   • If you decline these terms, please do not proceed with using our Site or any related Services.

2. INFORMATION WE COLLECT

We collect various types of information to operate effectively across all 50 states and provide you with meaningful Services. “Personal Information” refers to data that can identify or is reasonably capable of being associated with you. This does not include publicly available, aggregated, or de-identified information.

3. 1-TO-1 CONSENT TO CONNECT WITH CONTRACTORS

We offer a free roofing measurement and estimation tool; you may receive up to three (3) contractor estimates if you choose to connect:

1. Express Written Consent & E-Signature
   • By clicking a “Connect” button (or similarly labeled button) to contact a specific contractor, you provide express written consent (via e-signature) for that contractor, Pure Finance Group, and Instant Roofer to contact you regarding your project at the phone number and email you provided.
   • Such contact may include automated dialing systems, SMS/MMS text messages, and prerecorded messages for marketing or roofing estimates. Consent is not a condition of any purchase.
2. No Obligation
   • You can choose fewer contractors or none at all. Declining consent does not prevent you from using our basic Services.
3. Reference to Terms of Use
   • Additional rights and obligations for these connections are outlined in our Terms of Use.

4. HOW WE USE YOUR INFORMATION

We use your Personal Information for various business and commercial purposes, including:

1. Providing and Improving Services
   • Creating instant roofing estimates, facilitating communication with contractors, and enhancing user experiences.
2. Marketing and Promotions
   • Sending you offers, newsletters, or promotions, where permitted by law and in line with your preferences.
3. Research and Analytics
   • Performing data analytics to improve site features, measure performance, and understand user trends.
4. Security, Fraud Detection, and Compliance
   • Protecting against unauthorized access or activity, and complying with applicable laws and regulations.

5. SHARING OF INFORMATION

We may share your Personal Information with:

1. Contractors (Affiliate or Non-Affiliate)
   • To provide roofing estimates or otherwise fulfill your requests. These contractors are independent businesses, not employed by us.
2. Service Providers (“Vendors”)
   • Payment processors, hosting providers, analytics services, or other partners who assist in delivering our Services.
3. Financing/Credit Partners
   • If you seek financing or we process a soft credit pull through Pure Finance Group or similar entities.
   • Important: Instant Roofer is not a Consumer Reporting Agency under the Fair Credit Reporting Act (FCRA), and any credit checks are handled by our partners under their respective privacy policies.
4. Legal, Regulatory, or Safety Reasons
   • Where we believe disclosure is necessary to comply with laws, protect our rights, investigate fraud, or respond to lawful requests.

We Do Not “Sell” Your Data

• Instant Roofer does not “sell” personal information as defined by applicable U.S. privacy laws. However, certain third-party technologies used for analytics or advertising may be interpreted as a “sale” in some states. See Section 8 for more details.

6. DNC (DO NOT CONTACT) REQUESTS

1. Opting Out
   • If you wish to stop receiving marketing communications, submit a DNC request via our (DNC) do not contact form below or email us at [email protected]. We will update our records accordingly.
2. Partner Notification
   • After we mark you as DNC, we will make reasonable efforts to notify contractors/partners who received your information to remove you from future marketing outreach.
   • Disclaimer: We cannot control or guarantee immediate processing by each independent third party, but we will exercise good faith efforts to ensure compliance.
3. Transactional Communications
   • Even if you opt out of marketing, we may still send you emails or calls regarding active services or required legal notices.

7. LOCAL LAW COMPLIANCE & CONTRACTOR LICENSING DISCLAIMER

1. Local Building Codes & Licensing
   • Roofing contractors must comply with local, state, and federal requirements. Instant Roofer does not always verify contractor licensing, insurance, or code compliance in each of the 50 states.
   • It is your responsibility to ensure any contractor you hire meets all legal and regulatory requirements in your jurisdiction.
2. No Guarantee of Contractor Quality
   • We do not endorse or guarantee any contractor’s skills, pricing, or practices. All agreements for roofing services are exclusively between you and the contractor.
3. Limitation of Liability
   • Please review our Terms of Use for details regarding limitations of liability and dispute resolution.

8. STATE-SPECIFIC PRIVACY RIGHTS

Various U.S. states (including California, Colorado, Connecticut, Virginia, Utah, and Nevada) have enacted or are enacting privacy laws granting residents specific rights. Depending on your state of residence, these may include:

1. Right to Know
   • Request the categories and specific pieces of Personal Information we have collected, including sources and purposes for collection.
2. Right to Delete
   • Ask us to delete your Personal Information, subject to statutory exceptions.
3. Right to Correct
   • In some states, request correction of inaccurate Personal Information.
4. Right to Opt Out
   • Opt out of certain data-sharing practices interpreted as “sales” or “targeted advertising.”
5. Non-Discrimination

8.1 California Residents (CCPA)

• You have the above rights under the California Consumer Privacy Act (CCPA). To submit a verifiable consumer request, please contact us using the details in Section 13. We may request additional information to confirm your identity.

8.2 Nevada Residents

• Under Nevada law, residents may opt out of the sale of “covered information.” We do not sell covered information. If that changes, we will provide a method to opt out.

9. TCPA & TELEMARKETING COMPLIANCE

• Federal & State Laws: We comply with the Telephone Consumer Protection Act (TCPA) and other relevant laws across all states, which regulate automated calls, texts, and do-not-call lists.
• Consent Not Required: Providing consent is not a condition to receive products or services. You may opt out at any time.
• Contractor/Partner Compliance: While we contractually require our partners and contractors to comply with telemarketing regulations, Instant Roofer cannot guarantee the real-time or complete compliance of these independent entities.

10. DATA RETENTION

• Retention Periods: We keep your Personal Information only as long as is necessary to fulfill the purposes outlined in this Policy, or as required by law (whichever is longer).
• Deletion Requests: If you request deletion of your data under applicable law, we will delete it unless we are required or permitted to retain it for legal, regulatory, or internal record-keeping purposes.

11. NOT A HEALTH OR MEDICAL SERVICE

• No HIPAA Applicability: We do not collect or process protected health information (PHI) under the Health Insurance Portability and Accountability Act (HIPAA). Our Services are not intended to handle any medical or healthcare data.

12. SECURITY MEASURES

We implement commercially reasonable technical and organizational measures to protect against unauthorized access to your Personal Information. However, no security system is foolproof. By using our Services, you acknowledge that you provide your information at your own risk.

14. USE OF SERVICES BY MINORS

• Under 13 Prohibited: Our Services are not designed for children under thirteen (13) years old.
• Under 18: Individuals under eighteen (18) should not submit Personal Information through our Site. If you believe we have received data from someone under 18, contact us so we can promptly delete it.

15. DATA TRANSFERS & OPERATING IN 50 STATES

• U.S.-Based Services: We operate in the United States and store or process Personal Information on servers located in the U.S.
• Cross-State Considerations: By using our Services, you acknowledge that data protection laws vary by state. We strive to comply with relevant laws in each jurisdiction where we operate.

16. RELATIONSHIP & LIABILITY DISCLAIMERS

1. Facilitator Role Only
   • Instant Roofer is a platform that connects homeowners with independent roofing contractors. We do not provide roofing services ourselves.
2. No Attorney-Client Relationship
   • Communicating with us does not create an attorney-client relationship. We are not a law firm.
3. Limited Liability
   • Please review our Terms of Use for limitations on our liability regarding contractor selection, local code compliance, or any damages arising from the use of our Services.

17. THIRD-PARTY LINKS & WEBSITES

Our Site may link to websites or services that we do not operate or control. We are not responsible for the privacy practices of these third-party sites. We encourage you to review their respective privacy policies.

18. CHANGES TO THIS PRIVACY POLICY

We may update or revise this Privacy Policy at any time to reflect changes in our practices, services, or legal requirements. Any changes become effective when posted with the updated “Effective/Last Revised” date at the top. We encourage you to review this Policy periodically.

19. ASSIGNMENT

In the event of a merger, acquisition, reorganization, sale of assets, or bankruptcy, we reserve the right to transfer or assign your Personal Information as part of that transaction, subject to any pre-existing privacy commitments.

20. CALIFORNIA USERS: YOUR RIGHTS (EXPANDED)

If you are a California resident, you may have the right to request that we disclose certain information to you about our collection, use, and disclosure of your personal information over the last twelve months. If you live in California and wish to submit such a request, please contact us using the information below under “CONTACT INFORMATION.” Once we receive and confirm your verifiable request, we will process it and provide you with information as required by applicable law.

Up on the roof technologies, Inc. California Consumer Act Privacy Notice

This California Consumer Act Privacy Notice (“CCPA Notice”) applies to “Consumers” as defined by the California Consumer Privacy Act (“CCPA”). For the purpose of this CCPA Notice, personal information applies to “Personal Information” as defined by the CCPA (also referred to herein as “PI”).

We collect and share the following categories of PI from the corresponding sources and for the corresponding purposes set forth in the table below.

In addition, we may collect, use and disclose your PI as required or permitted by applicable law, or as directed by you, in accordance with this Privacy Policy.

We do not “sell” personal information that we collect from you, in accordance with the definition of “sell” in the CCPA, and will treat personal information we collect from you as subject to a do not sell request. There is not yet a consensus as to whether third party cookies and tracking devices associated with our websites and mobile apps may constitute a “sale” of your PI as defined by the CCPA. You can exercise control over browser-based cookies by adjusting the settings on your browser. We do not represent that these third-party tools, programs or statements are complete or accurate.

Some browsers have signals that may be characterized as do not track signals, but we do not understand them to operate in that manner or to indicate a do not sell expression by you so we currently do not recognize these as a do not sell request. We understand that various parties are developing do not sell signals and we may recognize certain such signals if we conclude such a program is appropriate.

California Consumers have the right to exercise the privacy rights under the CCPA. California Consumers may exercise these rights via an authorized agent who meets the agency requirements of the CCPA. Any request you submit to us is subject to an identification and residency verification process (“Verifiable Consumer Request”). We will not fulfill your CCPA request unless you have provided sufficient information for us to reasonably verify you are the Consumer about whom we collected PI. Please follow the instructions below and respond to any follow up inquiries we may make.

Some personal information we maintain about Consumers is not sufficiently associated with enough personal information about the Consumer for us to be able to verify that it is a particular Consumer’s personal information (e.g., clickstream data tied only to a pseudonymous browser ID). As required by the CCPA, we do not include that personal information in response to Verifiable Consumer Requests. If we cannot comply with a request, we will explain the reasons in our response.

We will make commercially reasonable efforts to identify Consumer PI that we collect, process, store, disclose, and otherwise use and to respond to your California Consumer privacy rights requests. We will typically not charge a fee to fully respond to your requests, but we may charge a reasonable fee, or refuse to act upon a request, if your request is excessive, repetitive, unfounded, or overly burdensome.

• The business or commercial purposes for our collecting or selling your PI.

Please note that PI is retained by us for various time periods, so we may not be able to fully respond to what might be relevant going back 12 months prior to the request.

Except to the extent we have a basis for retention under CCPA, you may request that we delete your PI that we have collected directly from you and are maintaining. Note also that we are not required to delete your PI that we did not collect directly from you.

We will not discriminate against you in a manner prohibited by the CCPA because you exercise your CCPA rights. However, we may charge a different price or rate, or offer a different level or quality of good or service, to the extent that doing so is reasonably related to the value of the applicable data. In addition, we may offer you financial incentives for the collection, sale and retention and use of your PI as permitted by the CCPA that can, without limitation, result in reasonably different prices, rates, or quality levels. The material aspects of any financial incentive will be explained and described in its program terms. Please note that participating in incentive programs is entirely optional, you will have to affirmatively opt-in to the program and you can opt-out of each program (i.e., terminate participation and forgo the ongoing incentives) prospectively by following the instructions in the applicable program description and terms. 20. YOUR NEVADA PRIVACY RIGHTS (EXPANDED)

Under Nevada law, Nevada residents may opt out of the sale of certain “covered information” collected by operators of websites or online services. We currently do not sell covered information, as “sale” is defined by such law, and we don’t have plans to sell this information. However, if you would like to be notified if we decide in the future to sell personal information covered by the Act, please contact us using this form to provide your name and email address. You are responsible for updating any change in your email address by the same method and we are not obligated to cross-reference other emails you may have otherwise provided us for other purposes. We will maintain this information and contact you if our plans change. At that time we will create a process for verifying your identity and providing an opportunity to verified consumers to complete their opt-out. We may share your data as explained in this privacy policy, such as to enhance your experiences and our services, and those activities will be unaffected by a Nevada do not sell request.
