TCPA – The Details
What is TCPA? The Telephone Consumer Protection Act (TCPA) a law passed in 1991 in the United States aims to shield consumers from intrusive telemarketing calls and texts well as faxes that they did not solicit for personally or professionally.
What Is Changing?
In January 2025 the Federal Communications Commission (FCC) has revised the definition of “prior express written consent.” Now, businesses must obtain consent that authorizes communications from a single, specifically identified seller. This change eliminates the practice of obtaining blanket consent for multiple entities, ensuring consumers are aware of exactly who will contact them.
How Does This Change Affect Roofing Companies?
Many roofing contractors, and contractors in general, often use subcontractors for specific portions of their projects. For example, a solar company may hire an electrician to handle a subpanel installation or additional meter setup. While it may be acceptable for a subcontractor to contact the homeowner to coordinate project-related work, issues can arise if the subcontractor initiates marketing communications to the homeowner without obtaining the required one-to-one consent. This could expose the initial contractor to potential liability for sharing the homeowner’s information without proper authorization, violating TCPA guidelines.
How Does Instant Roofer Contact Form Help?
The goal of the free contact form embed is to help contractors maintain proof of consent. By tracking IP addresses, recording video interactions, and certifying each submission, contractors gain an unalterable reference point showing when, where, and how the homeowner consented to receive marketing communications. In the event of a TCPA claim, contractors can present this evidence to demonstrate compliance. While we cannot guarantee that our technology will entirely prevent a TCPA claim, it provides a strong starting point to protect roofing contractors from potential claims, which could cost up to $1,500 per violation.
How Long Does Consent Certificates Last?
We currently do not have a mechanism to remove certificates. Meaning they will remain stored online forever. To keep our database from growing too large we may archive certificates older than 7 years.

Can Certificates Be Manipulated?
No, the very nature of the certificate means that if any party attempted to manipulate the certificate it would no longer become valid. In a sense the certificate ID is directly related to it’s creation. Any attempt to manipulate the certificate will prove it’s been altered and is no longer void. Giving the certificates created the ultimate validation of proof. Once it’s written it cannot be altered.

What is TCPA Compliance?
TCPA stands for the Telephone Consumer Protection Act, a federal law designed to protect consumers from unwanted telemarketing calls, texts, and faxes. For roofing contractors, compliance with TCPA means ensuring you have prior consent from potential clients before reaching out to them via phone or SMS for marketing purposes.
What are the main requirements for TCPA compliance?
TCPA compliance requires obtaining prior express consent from the person you’re contacting. This means that individuals must clearly agree to receive communications from your business. Additionally, you must honor opt-out requests and avoid contacting numbers on the National Do Not Call Registry.
What constitutes a TCPA violation?
Common TCPA violations include making calls or sending texts without consent, calling numbers on the Do Not Call list, using autodialing systems to contact people without permission, and not providing an opt-out option. Violations can result in significant fines, so it’s important to adhere to these regulations closely.
How can I make sure my roofing business is TCPA compliant?
To stay compliant, ensure that your contact forms collect explicit consent from potential customers. This can include a checkbox for them to agree to receive marketing calls or texts from your business. Keep records of consent, train your team on TCPA guidelines, and regularly review your calling practices to align with current TCPA rules.
What are the new TCPA rules for 2025?
The TCPA rules are updated periodically, and changes for 2025 focus on stricter consent requirements and enforcement. This may include clearer guidelines on how consent is obtained and tracked, increased penalties for non-compliance, and potentially tighter restrictions on the use of automated calling systems.
